At Syver Blau Godall, S.L. (hereafter «Blaucar») we protect your privacy and are committed to processing your personal data in accordance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 on Personal Data Protection and Guarantee of Digital Rights (LOPDGDD).

2. Purposes of processing

Blaucar processes the personal data you provide us with for the following purposes:

  • Vehicle rental booking and contract management, including driver identification, contract formalisation, invoicing and service provision.
  • Enquiries management received via the contact form, email, telephone or WhatsApp.
  • Compliance with legal obligations (accounting, tax, road safety, fine management, competent authority requirements).
  • Sending commercial communications regarding our services, offers or news, only when there is express consent or a prior contractual relationship.
  • Statistical analysis and website improvement as part of our use of cookies and similar technologies, in accordance with our Cookie policy.

3. Legal basis for processing

  • Contract execution for rent or for pre-contractual procedures requested by the user (Art. 6.1.b GDPR).
  • Compliance with legal obligations applicable to Blaucar (Art. 6.1.c GDPR).
  • Consent of the user for specific purposes (sending commercial communications, non-essential cookies) (Art. 6.1.a GDPR).
  • Legitimate interest from Blaucar for handling queries, fraud prevention and service quality improvement (Art. 6.1.f GDPR).

4. Categories of data processed

  • Identification details Name, surnames, ID card or passport number, date of birth, postal address.
  • Contact details phone, email.
  • Driving licence details Number, date of issue and expiry, issuing country.
  • Economic data Bank card (processed by the payment gateway, not stored by Blaucar).
  • Vehicle and booking details: Selected category, dates, pick-up and return location, mileage, issues.
  • Navigation data: IP address, cookie identifier, pages visited, time on site (see cookie policy).

5. Data Retention

  • Customer data with a formalised contract: during the term of the contract and, subsequently, during the applicable statutory periods (10 years for accounting obligations; other periods depending on tax, commercial, road safety, or legal prescription regulations).
  • Data provided via the contact form without subsequent processing: up to 12 months after the last interaction.
  • Commercial communications data: until the user withdraws their consent.
  • Navigation and cookie data: see duration in the Cookie policy.

6. Recipients and data communication

Blaucar may share your data with the following recipients, always based on a valid legal ground:

  • Insurance companies in the event of an accident with the hired vehicle.
  • Payment gateway and banking institutions to process the payment of the reservation and the deposit.
  • Public Administrations, Law Enforcement Bodies and Courts when there is a legal obligation (especially in traffic penalty management).
  • Accounting and tax advice contracted by Blaucar for the fulfilment of tax obligations.
  • Technology providers who provide services to Blaucar as data processors (web hosting, booking platform, analytical tools, digital advertising).

Some of these technology providers (for example, Google and Meta) may process data in countries outside the European Economic Area. In such cases, international transfers are carried out with the appropriate safeguards provided for in the GDPR (standard contractual clauses approved by the European Commission or other equivalent mechanisms).

7. User rights

As the data subject, you can exercise the following rights at any time:

  • Access obtain confirmation of whether we process your data and, if so, a copy.
  • Correction: correct inaccurate or incomplete data.
  • Erasure («right to be forgotten»): request removal when no longer needed.
  • Opposition to refuse treatment for reasons relating to your particular situation.
  • Limitation request the restriction of processing in the cases provided for by the GDPR.
  • Portability receive your data in a structured format or request its transmission to another controller.
  • Withdrawal of consent at any time, without affecting the lawfulness of the processing prior to its withdrawal.

To exercise these rights, write to us at info@blaucar.com indicating «Data Protection» in the subject line and attaching a copy of your ID card or equivalent identification document. We will attend to your request within a maximum of one month.

If you believe the processing of your data does not comply with regulations or that we have not correctly attended to your rights, you can submit a complaint to the Spanish Data Protection Agency (AEPD): www.aepd.es.

8. Data Security

Blaucar has adopted the necessary technical and organisational measures to ensure the security and integrity of the personal data processed, as well as to prevent its alteration, loss, unauthorised processing or access, in accordance with Article 32 of the GDPR.

9. Changes to the Privacy Policy

Blaucar reserves the right to modify this policy to adapt to legislative, jurisprudential or its own activity developments. Any modification will be published on this same page, indicating the date of the last update.
